    Please note that this privacy policy may be amended or supplemented at any time by GILAC, in particular in order to comply with any legislative, regulatory, case-law or technological developments. I. PERSONAL DATA

    In general, you can visit the GILAC Site without providing any personal information about yourself. In any event, you are under no obligation to provide this information to GILAC.

    However, if you refuse to provide such information, you may not be able to access certain information or services that you have requested. In this respect, GILAC may, in certain cases, ask you to provide certain personal information, as described below. By providing this information, you expressly agree that it may be processed by GILAC for the purposes indicated in point 2 below, as well as for the purposes specified at the end of each form.

    What personal data is collected?

    We collect and process, in particular:

    • identification data: the language in which you interact with us, surname, first name, address, email address, encrypted password, customer ID and telephone number;
    • connection data: IP address, browser, type of connection device, such as computer or mobile phone;
    • browsing data: products, technical data sheets and catalogues viewed;
    • commercial data: messages or questions sent to customer service, order history and order status.

    The mandatory or optional nature of the data is indicated at the time of collection by an asterisk. Some data is collected automatically as a result of your actions on the Site. Other information may be transmitted by partner service applications if you are a GILAC customer, such as GILAC CRM and production management applications. In such cases, we inform you that the transfer of your data will be carried out with appropriate safeguards and with the security of your data always preserved.

    When?

    We collect the information you provide to us, in particular when:

    • you browse our Site and view products, technical data sheets and catalogues;
    • you contact our Customer Service Department via the email address gilac@gilac.com or via the contact form;
    • you place an order or request a quote on the customer-only section of our Site;
    • you subscribe to the GILAC newsletter;
    • you follow GILAC on social media.

    In accordance with the General Data Protection Regulation adopted by the European Parliament on 27 April 2016, and the amended French Data Protection Act of 6 January 1978, GILAC informs you of the following points:

    1. IDENTITY OF THE DATA CONTROLLER

    The data controller is GILAC, whose registered office is located at 154 Allée de Grande Croix, 69280 Marcy-l’Étoile, France.

    1. PURPOSES OF PROCESSING

    GILAC may process your Personal Information:

    • to manage your customer registration on our Site, in the customer-only section of the Site;
    • for the implementation, application and performance of the purchase or service contract entered into with us, in the customer-only section of the Site, including order management;
    • to respond to requests or enquiries made through Customer Service channels;
    • for marketing purposes, if you have subscribed to the newsletter, or to personalise our services and the promotional messages we send you;
    • for customer knowledge purposes and statistics relating to the performance of our Site.
    1. RECIPIENTS

    GILAC is the sole recipient of your Personal Information. This information, whether in individual or aggregated form, is never transmitted to a third party, notwithstanding the processors used by GILAC, further information on which is provided in point 7 below.

    Neither GILAC nor any of its processors sells the personal data of visitors and Users of its Site.

    1. RETENTION PERIOD

    Your Personal Information is retained by GILAC only for the time required for the purpose for which it was collected, as indicated in point 2. The retention period for your data depends on the purposes for which it is processed, as explained below:

    Customer service: we will process your data for the time necessary to respond to your enquiry or request.

    Marketing: we will process your personal data until you unsubscribe or cancel your newsletter subscription. If you take part in promotional activities as a prospect, we will retain your personal data for a maximum of 6 months. If you take part as a customer, we will retain your personal data for as long as you remain a GILAC customer. You may unsubscribe from promotional activities at any time.

    Customer registration: your data will be processed for as long as you remain a registered user and/or GILAC customer, i.e. until you decide to delete your customer account.

    Implementation, application and performance of the purchase contract: we will process your data for the time necessary to manage the purchase of the products or services you have requested, including any returns, complaints or claims associated with the purchase of the product or service requested.

    Site statistics and ergonomics: we will process your data occasionally for the duration of a request, for example connections by country. Whenever possible, we favour the anonymisation of your data. For example, your passwords are already encrypted and we have no access to them.

    In the specific case of product orders placed by customers via the customer-only section of the Site: independently of the processing of your personal data for the period strictly necessary to fulfil the corresponding purpose as indicated above, this data will then be retained, duly backed up and protected with restricted access, for the period during which liability could be incurred as a result of the processing, in accordance with the regulations in force at any given time. The personal data will be deleted once any possible actions in each case are time-barred.

    1. DATA PROTECTION RIGHTS

    You have the following rights regarding your Personal Information, which you may exercise by writing to us at the postal address mentioned in point 1.

    Right of access to and communication of data

    You have the right to access the Personal Information concerning you.

    However, due to GILAC’s obligation to ensure the security and confidentiality of personal data processing, you are informed that your request will be processed subject to you providing proof of your identity, in particular by producing a scan of your valid identity document, in the case of a request made via our dedicated electronic form, or a signed photocopy of your valid identity document, in the case of a request made in writing.

    GILAC informs you that it will be entitled, where applicable, to object to requests that are manifestly abusive due to their number, repetitive nature or systematic nature.

    You may also define general and specific instructions regarding the handling of your personal data after your death. Where applicable, the heirs of a deceased person may request that the death of their relative be taken into account and/or that the necessary updates be made.

    To help you with this process, in particular if you wish to exercise, on your own behalf or on behalf of a deceased relative, your right to rectification by means of a written request sent to the postal address mentioned in point 1, you will find, by clicking on the following link, a template letter prepared by the CNIL:

    • where the exercise of this right is based on legitimate grounds; or
    • where the exercise of this right is intended to prevent the data collected from being used for commercial prospecting purposes.

    To help you with this process, in particular if you wish to exercise your right to object by means of a written request sent to the postal address indicated in point 1, you will find, by clicking on the following link, a template letter prepared by the CNIL:

    1. COMPLAINT TO THE COMPETENT AUTHORITY

    II. COOKIE POLICY

    When you first connect to the GILAC website, a banner at the bottom of your screen informs you that information relating to your browsing may be stored in files known as “cookies”. Our cookie policy helps you better understand the measures we implement regarding browsing on our website. In particular, it informs you of all the cookies present on our website, their purpose, in part I, and explains how to configure them, in part II.

    1. GENERAL INFORMATION ABOUT COOKIES ON THE GILAC SITE

    GILAC, as publisher of this website, may place a cookie on the hard drive of your device, such as a computer, tablet or mobile phone, in order to ensure smooth and optimal browsing on our website.

    “Cookies”, or connection trackers, are small text files of limited size which allow us to recognise your computer, tablet or mobile phone for the purpose of personalising the services we offer you.

    The information collected through cookies does not allow you to be personally identified in any way. It is used exclusively for our own purposes in order to improve the interactivity and performance of our website and to send you content tailored to your interests. None of this information is communicated to third parties unless GILAC has obtained your prior consent or where disclosure of this information is required by law, by court order or by any administrative or judicial authority authorised to request it.

    To provide you with clearer information about the data identified by cookies, you will find below a table listing the different types of cookies that may be used on the GILAC website, their name, purpose and retention period.

    1. CONFIGURATION OF YOUR COOKIE PREFERENCES

    You may accept or refuse the placement of cookies at any time.

    When you first connect to the GILAC website, a banner presenting brief information about the placement of cookies and similar technologies appears at the bottom of your screen. This banner informs you that by continuing to browse the GILAC website, for example by loading a new page or clicking on various elements of the Site, you accept the placement of cookies on your device. You are also deemed to have given your consent to the placement of cookies by clicking on the “OK, accept all” button on the right-hand side of the banner appearing at the bottom of your screen.

    Depending on the type of cookie concerned, your consent may be required before cookies can be placed on and read from your device.

    a. Cookies exempt from consent

    In accordance with the recommendations of the French Data Protection Authority, the CNIL, certain cookies are exempt from prior consent where they are strictly necessary for the operation of the website or where their sole purpose is to enable or facilitate communication by electronic means. These include, in particular, session identifier cookies, authentication cookies, load-balancing session cookies and interface personalisation cookies. These cookies are fully subject to this policy insofar as they are issued and managed by GILAC.

    b. Cookies requiring prior consent

    This requirement applies to cookies issued by third parties and classified as “persistent”, insofar as they remain on your device until they are deleted or until their expiry date.

    As such cookies are issued by third parties, their use and placement are subject to those third parties’ own privacy policies, links to which are provided below. This family of cookies includes audience measurement cookies, notably Google Analytics, advertising cookies, which GILAC does not use, and social media sharing cookies, notably Facebook, Pinterest and LinkedIn.

    Audience measurement cookies establish statistics relating to visits to and use of various elements of the website, such as the content and pages you have visited. This data helps improve the ergonomics of the GILAC website. One audience measurement tool is used on this website:

    Google Analytics, whose privacy policy is available at the following link: https://www.google.com/analytics/learn/privacy.html?hl=fr

    Social media sharing cookies are issued and managed by the publisher of the social network concerned. Subject to your consent, these cookies allow you to easily share part of the content published on the GILAC Site, in particular via an application “button” for sharing content according to the social network concerned. Three types of social media sharing cookies are present on the GILAC Site:

    c. You have various tools for configuring cookies

    Most Internet browsers are configured by default to allow cookies to be placed. Your browser gives you the option to modify these standard settings so that all cookies are systematically refused, or so that only some cookies are accepted or refused depending on their issuer.

    PLEASE NOTE: We draw your attention to the fact that refusing the placement of cookies on your device may nevertheless affect your user experience and your access to certain services or features of this website. Where applicable, GILAC declines all liability for the consequences linked to the deterioration of your browsing conditions resulting from your choice to refuse, delete or block the cookies necessary for the operation of the Site. These consequences shall not constitute damage and you shall not be entitled to any compensation on this basis.

    Your browser also allows you to delete existing cookies from your device or to notify you when new cookies may be placed on your device. These settings do not affect your browsing but will cause you to lose all the benefits provided by the cookie.

    Please find below the various tools available to you so that you can configure the cookies placed on your device.

    d. Configuring your Internet browser

    Each Internet browser has its own cookie management settings. To find out how to change your cookie preferences, please see below the links to the help pages that will allow you to access the relevant menu in your browser:

    III. POLICY ON TRACKING PIXELS IN EMAILS

    When you receive commercial emails from Gilac, some messages may contain tracking pixels. These pixels make it possible to know whether an email has been opened, to measure the performance of our communications and, where you have accepted this, to adapt the content or frequency of our emails to your interests.

    These pixels are not used in transactional or administrative emails that are strictly necessary for the monitoring of your orders, invoices, deliveries or requests.

    You may accept or refuse the use of these pixels at any time via the preferences management link included in our emails. Refusing tracking pixels does not prevent you from receiving the commercial communications to which you have subscribed. It simply means that Gilac will not use your email openings to measure your engagement or personalise its emails.
